1. The CircleDNA Health Screening Week Social Media Contest (“Contest”) is sponsored by Prenetics Limited (“Sponsor”).
2. Agreement to Terms and Conditions: By participating in this Contest, the entrant (“Entrant”) agrees to these Terms and Conditions and the Sponsor’s decisions and interpretations, which are final and binding in all matters related to the Contest. In the event of any conflict between these Terms and Conditions and any other material published in connection with this Contest, these Terms and Conditions shall prevail.
3. Contest Period: This Contest begins on15 August 2024 00:00 to 19 August 2024 16:00 (“Contest Period”). All timings are based on the Hong Kong Time on the Sponsor’s servers.
4. Eligibility: This Contest is only open to individuals who are at least (i) eighteen (18) years old, and (ii) the legal age of majority in the individual’s place of residence at the time of Entry. Each such individual is an “Entrant”. Employees of the Sponsor and each of its respective parent companies, subsidiaries, and affiliates and each of their immediate family members (e.g., spouse, parent, child, sibling, and their respective spouses and the “steps” of each, regardless of where they reside) and persons living in the same household of each, whether or not related, are not eligible to enter this Contest.
5. How to enter: To participate in this Contest, Entrants are required to do the following during the Contest Period:
- Make a purchase of a CircleDNA product between 15 August 2024 and 19 August 2024 (both dates included).
- Post a comment telling us “When was your last health screening?” (Eg. “My last health screening was 3 years ago… I should do one soon.” on our Health Screening Week Giveaway Post on Facebook or Instagram (“Entry” or “Entries”).
- Set entries/posts to public.
6. Content Restrictions: Entries shall not: (i) contain any harmful, threatening, derogatory, defamatory, libellous, tortuous, misleading, offensive or any other objectionable content; (ii) promote bigotry, racism, hatred, or harm against any group or individual; (iii) contain pornographic, sexually explicit, obscene or indecent language; (iv) promote discrimination based on race, sex, religion, nationality, disability, ethnicity or sexual orientation; (v) be otherwise inappropriate or offensive. Any Entry submitted by Participants that is found to include the above elements will be automatically disqualified without notice.
7. Publicity Rights: By participating in this Contest and posting and submitting comments, (i) the Entrant authorizes and agrees to provide the Sponsor and its affiliates a worldwide license to use, edit, adapt, publish, translate, create adaptations from, or share such comments in other social media or marketing materials in the future without payment or prior notice to the Entrant; and (ii) the Entrant warrants that it has the right to grant such license. If an Entry is subject to the rights of third parties, the Entrant shall have obtained clear and unambiguous prior consent from such third parties as a requisite for such Entry to be valid in this Contest.
8. Adjudication and Prize: 1 winner who is judged by the Sponsor to have submitted the most constructive and creative Entry shall be rewarded with a Apple Watch Series 9 45mm + Nike Rubber Strap valued at USD 800. (Note: Value may vary due to currency conversions, depending on the country that the winner resides in). This Contest is a game of skill and chance plays no part in determining the winners.
9. Notification of Winners: The Sponsor will notify the potential winners via Facebook or Instagram Direct Message by 30 September 2024, Hong Kong Time, and will request for certain information from the potential winner, including evidence of their purchase (purchase order number) within 7 days. A Prize will only be awarded to a winner whose eligibility is verified by the Sponsor and failure by a potential winner to provide all required information in their reply by return within the time period specified by the Sponsor may result in forfeiture of that winner’s right to claim his/her Prize. If a potential winner is disqualified, found to be ineligible or not in compliance with these Terms and Conditions, or declines to accept a Prize, the Prize may be awarded to an alternate winner.
10. Each winner shall be solely responsible for payment of any and all applicable federal, state, and local taxes, and any other costs and expenses not expressly set forth herein in connection with his/her Prize. Prizes are non-transferable, and no Prize substitution, exchange or cash equivalent will be allowed, except by the Sponsor, who reserves the right to substitute a Prize of equal or greater value in case of unavailability of a Prize, force majeure, or requirements in the Entrant’s jurisdiction.
General:
11. To the extent permitted by law, the Sponsor makes no warranties, representations or guarantees, express or implied, in fact or in law, as regards to this Contest.
12. Where promotional programs such as this Contest are or become unlawful, or unlawful without registration or other license, in an Entrant’s jurisdiction, the Sponsor reserves the right to disqualify the Entrant’s submission.
13. The Sponsor shall not be liable for any loss or damage whatsoever which is suffered (including, but not limited to, indirect, consequential or special loss) or for personal injury which is suffered or sustained, in connection with or arising from this Contest, including but not limited to (a) any Entry or prize that is incorrect, invalid, misdirected, disqualified, cancelled, late, delayed, lost, altered, damaged or otherwise interrupted (whether before or after their receipt by the Sponsor); (b) any technical issues (whether or not under the Sponsor’s control), unauthorised access or improper interference; (c) winner’s tax liability arising from or in connection with this Contest; or (d) use of a Prize by the winner, except if such liability cannot be excluded by laws.
14. If, for any reason, the Contest is not capable of running as planned, the Sponsor reserves the right, at its sole and absolute discretion, to cancel, terminate, modify or suspend this Contest and/or proceed with this Contest, including the selection of a winner in a manner it deems fair and reasonable, including the selection of a winner from among eligible entries received prior to such cancellation, termination, modification or suspension. In no event will more Prizes be awarded than are stated in these Terms and Conditions.
15. Disputes: This Contest is governed by, and will be construed in accordance with Hong Kong law. In the event of a dispute or claim arising under or in relation to this promotion, you submit to the exclusive jurisdiction of the courts of Hong Kong.
16. Privacy: The Sponsor shall process personal data provided by Entrants, if any, in accordance with its privacy policy available at https://circledna.com/en/privacy. Entrants may request the Sponsor to delete their personal data before this Contest concludes, but doing so may disqualify Entrants from participating in this Contest. The Sponsor reserves the right to disqualify Entrants from this Promotion if any personal data provided by Entrants is false, inaccurate, or misleading.
17. The Sponsor’s failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision and such provision shall remain in full force and effect.
18. The Sponsor reserves final rights if there is any dispute. The Terms and Conditions are subject to change without prior notice.
